THE LEGALITY OF BOOTS

I have a question.From what I understand it's not illegal to trade boots
it's only illegal to sell them. But what about CD-Rs? For instance I sell
CD-R boots BUT I'm not actually charging for the songs I'm charging for the
cost of the CD the jewel case any printed material and shipping. So is this
illegal???? It can't be because I'm not selling the songs, I'm selling the
material the song is on. I guess I could see it being illegal if they're
official releases but what about live performances? Aren't these considered
public domain? And if you pay the ticket price don't you in essence buy the
right to all the songs that were played at that concert? So in that case you
could buy the boot of the show you went to and it would be legal right?
